Any user should use due diligence to ensure the information is accurate, which cannot be guaranteed onsite. 2. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the state of Wyoming, USA, without regard to its conflict of law provisions. Any disputes arising out of or related to these Terms or the use of our Site shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. By using our Site, you agree to submit to arbitration in the state of Wyoming, USA.

3. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable.

These Terms, along with our Privacy Policy and any other legal notices published by Gammastrike, constitute the entire agreement between you and Gammastrike regarding the use of our Site.

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice before any new terms take effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the Site after such changes indicates your acceptance of the new terms.

Gammastrike shall not be liable for any failure to perform its obligations under these Terms if such failure results from circumstances beyond Gammastrike's reasonable control, including but not limited to acts of God, war, terrorism, cyber-attacks, or any other force majeure event.

10. Registration

This User Agreement between you (“You”) and Gammastrike (“gammastrike.com”) and any of our affiliates, agencies, sponsors, licensees, or content partners (collectively referred to as “Gammastrike”, “We”, or “Us”) governs your use of the Site, including any documents, content, services, functions, or features accessible on or through any products offered (the “Site”). By using the Site or any other website owned, operated, licensed, or controlled by Us, you agree to be bound by these Terms of Service.

10.1 Subscription and Billing

You agree to pay the predetermined subscription fee for your use of the Site. Beta participants (“Beta membership”) will be charged an annual subscription fee of $700 (USD), which is not subject to change for the duration of the account or Gammastrike. Beta participants' accounts must be paid in full at account initialization. These payments are non-refundable; should a payment fail, the subscription will be canceled. Should a payment be rejected or the subscription canceled prematurely, the amounts are not refundable. Users who opt out of the payment plan are not eligible for a refund on any previously made payments.

Where applicable customers may contact Gammastrike within the first fourteen days of service to cancel service at no penalty.

10.2 Account Access and Security

You agree not to share access to your account and not to redistribute any data you receive through your use of the Site or products. You are solely responsible for maintaining the confidentiality of your password and any activities that occur under your account. You must immediately notify Gammastrike of any unauthorized use of your account.

11. Digital Goods and Refund Policy

11.1 No Refund Policy

Since services are non-tangible, irrevocable, digital goods, we do not issue refunds. All sales are final. During checkout, upon clicking the final submit button on any payment to Gammastrike, your purchase is charged to the credit/debit card you supplied. You cannot cancel a purchase or receive a refund for a purchase.

11.2 Auto-Renewal

All plans auto-renew. If you do not wish to renew, you must cancel at least 24 hours prior to your renewal date. Subscription fees are payable monthly or annually in advance.

12. User Behavior and Code of Conduct

You agree to adhere to the Chat Code of Conduct and promote a positive, professional, and team-oriented atmosphere. Unauthorized solicitation, sharing premium data, or disruptive behavior in our message boards or Discord servers may result in account termination without compensation.

13. Privacy

We respect your privacy rights. We will not sell or distribute your email address or other information without your express consent. Only Gammastrike, our agencies, attorneys, and partners are entitled to your information. For more information, please refer to our Privacy Policy.

14. No Endorsement

You understand that neither Gammastrike, nor any part of the Service, or any equipment utilized by Gammastrike, is sponsored or endorsed by any Information Providers. Gammastrike may contain links to websites operated by parties other than Gammastrike. Such links are provided for your convenience only.

15. Copyright and Proprietary Data

The Site and all its contents are made available to you, with the agreement that you will not copy or reproduce the contents of this Site except for your own personal or internal company use. You agree not to alter, decompile, or disassemble any software provided as part of the Service.

16. Limitation of Liability

In no event will Gammastrike, its affiliates, partners, members, managers, directors, officers, employees, or agents be liable to you or any third person for any indirect, consequential, exemplary, incidental, special, or punitive damages, including for any lost profits or lost data arising from your use of the website. The liability of Gammastrike and its affiliates shall be limited to the amount paid by you to Gammastrike during the 12 months preceding the event giving rise to such claim.

17. Taxes

You shall be solely responsible for the payment of any taxes , charges, or assessments imposed on you or Gammastrike, relating to the provision of the Service. Gammastrike will collect and remit sales tax where required by law.

18. Compliance with Laws

You represent and warrant that you are not engaged in, and agree not to engage in, any unlawful transaction or business. You agree not to use the Information or Service for any unlawful purpose or in any manner not authorized by this Agreement.

19. Indemnification

You shall indemnify Gammastrike and its officers, directors, partners, employees, and agents against any and all claims or losses imposed on, incurred by, or asserted against them as a result of or relating to your non-compliance with any of the terms of this Agreement.

20. Discord Server Terms of Service

By joining our Discord server, you agree to the following terms:

  • Nothing on the Gammastrike platform, including this Discord server, should be considered financial advice.
  • The use of any ideas, systems, and/or data posted in the Gammastrike Discord server is at your own risk.

21. GDPR and CCPA Compliance

21.1 GDPR Compliance

22. Survival

The provisions of these Terms that by their nature should survive termination or expiration of this Agreement shall survive, including but not limited to, provisions relating to intellectual property, warranty disclaimers, indemnity, and limitations of liability.

23. Sharing of Images and Screenshots

You are permitted to share images and screenshots from the Site that contain the Gammastrike watermark. These images and screenshots must remain unaltered, and the watermark must be clearly visible. By sharing these materials, you agree that they will be used for personal or internal company use only and not for commercial purposes unless expressly authorized by Gammastrike. Any misuse of the shared content, including removing or obscuring the watermark, altering the content, or using it for unauthorized commercial purposes, may result in the termination of your account and legal action.
